Comments to the Media by Solicitors

The media continue to show great interest in legal matters, particularly cases of a sensational nature. The media is increasingly seeking the views of solicitors involved in court proceedings and also those representing special interest groups or with recognised experience in a particular field. While it is quite proper for solicitors to assist the media in conveying accurate information to the public, there should be no infringement of solicitors' obligations to their clients, the courts, the profession or the administration of justice. The Professional Practice Committee have therefore approved the following Guideline:

Solicitors presenting information to the media in relation to their clients' affairs are acting in a professional capacity. Solicitors should conduct themselves in their public appearances and public statements in the same manner as they would with their fellow practitioners and with the courts.

Before making a public statement concerning a client's affairs, a solicitor must first have the client's authority to do so and must also be satisfied that any communication is in the client's best interests. Solicitors should nor permit their personal interests or those of other causes to conflict with their client's interests.
