Guidelines on Common Repairs 1999
The Scottish Consumer Council has recently published a report on the views and experiences of owner occupiers in Scotland who share common property with their council. Its recommendations include the following: ‘‘Solicitors should always make sure prospective purchasers are aware of the conditions contained in their title deeds about the management of repairs.’’
‘‘The Law Society of Scotland should take steps to improve pre-purchase information given by solicitors about common repair responsibilities.’’ The Society’s Conveyancing Committee is of the view that current best practice already covers this but feels it appropriate to bring practitioners’ notice to the recommendations.
The report makes further recommendations to the Scottish Parliament, national bodies and local authorities.
