Mediation Schemes Reviewed
The public’s appetite for Alternative Dispute Resolution is greater than ever. The expense, investment of time involved in court proceedings and the courts greater enthusiasm for exploring the possibilities of ADR ensure the continued growth in this sector.
Those opting for Mediation as a means of dispute resolution require assurance as to the quality of the service being provided.
The Society operates two recognised Mediation Schemes:
Family Law Mediation with 49 Accredited Family Mediators and
Commercial Law Mediation with 12 Accredited Mediators.
Both of these schemes have been in service for some years and a substantial review of their operation was completed in November 2008. As a result of that review there have been a number of changes which should improve the service to both mediators and the public. Updated operating protocols will also improve consistency of operation and compliance with standards.
Essentially the changes which are effective for applications received on or after 1 March 2009 for both schemes are as follows:
New standard Application Form.
New standard Reference Form.
New standard set of Guidance Notes.
New standard Operating Protocol for Accreditation Panels.
The period of accreditation for both specialisms has been standardised at three years (reflecting an extension from two years in respect of Family Mediation)
The fee structure for both schemes has been brought in line with the standard charges for all Specialist Accreditations; £200 for First Accreditation and £150 for Renewal Accreditation.
The updated Application Forms, Guidance Notes and Reference Forms can be found on the Society's website at www.lawscot.org.uk
