Supporting separated families; securing children's futures

This consultation sets out the government's vision for transforming the child maintenance system so the emphasis is placed on supporting families to make their own arrangements. They set out details of proposals for co-ordinating support services for separated and separating families and outline the way in which the new statutory child maintenance scheme will operate. They also set out further information on the proposals for introducing service charging to encourage collaboration, the way in which victims of domestic violence will be treated and the process of closing existing CSA cases, and ask specific questions on these aspects of the plans.

Sheriff Court Rules Council Consultation: Proposals for Procedural Rules in the Sheriff Court for the Children's Hearings (Scotland) Act 2011

The Child Welfare Working Group was established by the Sheriff Court Rules Council in August 2011. Under the chairmanship of Sheriff Principal Scott and latterly Sheriff McCulloch, the group has recommended to the Council that new rules are necessary as a consequence of the Children's Hearings (Scotland) Act 2011.

The Child Support Maintenance Calculation Regulations 2012 - A technical consultation on the draft regulations

The draft Child Support Maintenance Calculation Regulations 2012 set out all the regulations relating to the calculation of maintenance for the purposes of the new statutory child maintenance scheme. They set out the rules relating to the calculation of maintenance, including how income is determined, and the circumstances in which those rules may be varied. They also include provisions about applications for a maintenance calculation and decision making in relation to the making and adjusting of the calculation.

The Children's Hearings (Scotland) Act 2011: Various pieces of secondary legislation to support implementation of the 2011 Act

The Children's Hearings (Scotland) Act 2011 received Royal Assent in January 2011 ("the 2011 Act"). The 2011 Act aims to strengthen and modernise the Children's Hearings system and brings into one place most of the children's hearings related legislation. A wide range of secondary legislation will support the implementation of the 2011 Act and this particular consultation deals with four smaller pieces of secondary legislation that would not necessarily merit a full consultation.
