Courts Reform (Scotland) Bill - Consultation on the treatment of civil appeals from the Court of Session

This paper follows on from the proposals in the recent consultation on the Courts Reform (Scotland) Bill to restructure the way civil cases and summary criminal cases are dealt with by the courts in Scotland. This paper proposes that the current arrangements - which provide an appeal route from the Inner House of the Court of Session to the United Kingdom Supreme Court on the certification of two counsel - should be replaced by leave to appeal.

Making Justice Work - Draft Courts Reform (Scotland) Bill

This consultation invites views on proposals to restructure the way civil cases and summary criminal cases are dealt with by the courts in Scotland. The proposals provide the legal framework for implementing the majority of recommendations of the Scottish Civil Courts Review, led by Lord Gill, the former Lord Justice Clerk and now Lord President of the Court of Session. The proposals discuss a redistribution of business from the Court of Session to the sheriff courts, creating a new lower tier of judiciary in the sheriff court called the summary sheriffs with jurisdiction in certain civil cases and summary criminal cases. Other proposed measures include the creation of a new national sheriff appeal court and a new national specialist personal injury court.

Civil Law of Damages: Issues in Personal Injury - A Consultation Paper

The consultation seeks views on aspects of the Scottish Law Commission's proposals for reform of the law on damages for psychiatric injury, the law on prescription and limitation (also known as time bar) for actions for personal injury and a range of related issues such as the discount rate; interest on damages and periodical payments.

Calling on the Scottish Parliament to urge the Scottish Government to create a Register of Pecuniary Interests of Judges Bill (as is currently being considered in New Zealand's Parliament) or amend present legislation to require all members of the judiciary in Scotland to submit their interests & hospitality received to a publicly available Register of Interests.
