Scottish Law Commission's discussion paper on double jeopardy

The Criminal Law Committee has submitted a response to the SLC's discussion paper on double jeopardy. The paper invited comments on whether it is desirable for any exceptions to the rule against double jeopardy to be introduced and if so, how they should operate. In its response, the committee agrees that the rule should be retained but that certain exceptions may be appropriate.

Criminal Justice and Licensing (Scotland) Bill

The committee has responded to the Justice Committee's call for written evidence on parts 1-7 of the Bill. The Bill represents a wide-ranging review of criminal law and the Society has responded to a number of Scottish Government consultation which are now contained in the Bill.
