Gillian McCluskey
Gillian is an experienced litigation practitioner, with her background lying both in the public and private sectors. She represents individuals, sole traders, large UK corporations, public bodies and international corporations both pursuing and defending cases in Sheriff Courts throughout Scotland, and instructing Counsel in Court of Session actions, across diverse areas from property litigation, commercial contract disputes, debt recovery and international enforcement, liquidation and sequestration, recovery of possession of heritable property, and multiplepoinding. Gillian has been instructed in a range of cases involving foreign judgments, from non-Scottish UK Judgments, through to EU, and worldwide, including countries with reciprocal provisions and those without. She was the lead solicitor in the case DRIKA BVBA & OTHERS against CLAIRE GILES [2017] CSOH 131 where she represented the Petitioners in successfully achieving registration of a foreign judgment by use of the court’s inherent discretion. This case led to a rule change in the rules of the Court of Session. Gillian is a Law Society of Scotland accredited specialist in Debt and Asset Recovery law and has previously tutored extensive courses on Debt Recovery and Advanced Debt Recovery. She also regularly undertakes pro bono work, and sits on the Board of Directors of the Scottish charity Young Enterprise Scotland.
