Letting agent code of practice update

With the Scottish Government’s Letting Agent Registration (Scotland) Regulations 2016 coming into effect next year, the Society has been actively involved in ongoing discussions to make sure that our members’ interests are represented.  

We are now pleased to confirm that the regulations will only apply to those individuals and organisations who carry out letting agency work. The regulations will not apply to the act of preparing a lease or those who do the preparation – and they will not be expected to register.

For those who do carry out letting agency work, the register is likely to start accepting applications from early in 2018 and you must have submitted an application by 30 September 2018. You must have the appropriate qualification in order to do so and there are currently two training programmes which lead to acceptable qualifications.

The Scottish Government's Guide to Letting Agent Registration provides a live source of relevant and useful information on the training requirements and providers, registration and other aspects of the regulations.

Take part

The Scottish Government is working on the development of a new IT system to assist with the administration of letting agent registration. It is working in partnership with Registers of Scotland and as part of the ‘Discovery’ phase of the project. Registers of Scotland is seeking feedback from potential users and is planning a survey of those who carry out letting agency work and would be happy to be approached via email by Registers of Scotland.
