Simple Procedure Rules amended from end of this month

A time to pay application is to be included as a form of response in the Simple Procedure Rules in the sheriff court, under rule changes confirmed in secondary legislation made by the Court of Session.

The Act of Sederunt (Simple Procedure Amendment) (Miscellaneous) 2018, which comes into force on 30 July 2018, also sets out a new procedure to recall a decision and makes other minor amendments.

These include substituted rules on applying tio have a decision recalled, which will not apply to decisions made before the commencement date.
