Tom Quail is Head of Family Law at Wright, Johnston & Mackenzie LLP. Tom is a Solicitor Advocate who has specialised in family law for over twenty years. Sections 9 and 10 of the Family Law (Scotland) Act 1985 set out the ‘fair sharing’ principle, which informs the court’s determination of the division of matrimonial assets on divorce and operates on the assumption that these are shared fairly where the division is equal.
