Cross border mental capacity frameworks
The Law Society of Scotland and Law Society of England and Wales have jointly developed an information note for solicitors in both jurisdictions providing clarity on the core provisions relating to mental capacity and incapacity law in the other jurisdiction to that in which they practice, the key differences between the two and key considerations relating to cross-border issues.
