Lady Tait ruled on the recent Court of Session case JMS v HMS ([2025] CSOH 80) It covered the question of how divorce would be covered when parties reside on opposing sides of the England-Scotland border. Join our two speakers, Rachael Kelsey Partner at SKO Family Law Specialists and Alex Carrurthers, Partner at Hughes Fowler Carruthers, to learn about the implications of the ruling on cross-border divorce cases.

Learning outcomes:

  • Understand Lady Tait’s decision and how it impacts Scottish solicitors
  • Identify how residence impacts the court’s decision
  • Learn about getting the correct domicile information from the outset
