Governance and regulation in sport
  • Legislative update: The Football Governance Bill – England and Wales
    • What are the implications, if any, for football in Scotland? Does increased regulation of football threaten competitiveness
  • Is a more uniform approach required for the regulation of all sport? What is the fairest and most effective model of sport governance
  • Case law update: The enforcement of Profit and Sustainability Rules in English football (e.g. the points deduction against Everton FC)
  • Discussion on best practice for compliance with sport regulations

Fair competition and breakaway sports leagues
  • Case law update: European Court of Justice ruling on the European Super League and the Sports Resolutions Panel decision on participation in LIV – what are the wider implications for new leagues and competitions in sports? Do these decisions illustrate a conflict between legal principles and sporting principles
  • Legislative update: Discussion of the Football Governance Bill’s stance on “prohibited competitions” – should we adopt the same approach in Scotland? Would similar legislation be appropriate to respond to the rise of breakaway competitions in other sports (e.g. LIV Golf)
  • Do breakaway competitions represent exciting new commercial opportunities, or a threat to good regulatory practice
  • What are the rights of athletes/clubs in engaging with breakaway competitions
