Debates surrounding the creation of the new Arbitration Act 2025 (England & Wales and Northern Ireland) included discussion on preventing fraud and corruption in arbitration. While no fraud-focused amendments made it into the final Act, such discussions have reiterated that fraud and corruption are an important concern for arbitration in all jurisdictions.

Gillian Carmichael Lemaire, Arbitrator & Mediator, and Chair of the Scottish Arbitration Centre, will shine a spotlight on fraud and corruption in arbitration with a focus on Scotland. We will use UK case law to expose how arbitration is susceptible to fraud and corruption and couple this analysis with conclusions from the ICC Commission on Arbitration and ADR’s paper regarding ‘red flag indicators of corruption in international arbitration’, to provide a holistic view on how to spot and stop fraud and corruption in Scotland’s systems of arbitration. Gillian will also consider whether our current legislation addresses the prevention of fraud and corruption in arbitrations in Scotland. This one-hour webinar will be relevant for those who work in arbitration and professionals who are interested in arbitration as an option for their clients.
